The agreements and policies that apply when you rent or host on OurSpace.

Prohibited Items Policy

This Prohibited Items Policy (the "Policy") applies to all storage and parking arrangements requested, offered, accepted, confirmed, or otherwise facilitated through the OurSpace mobile application, website, and related services (collectively, the "Platform").

OurSpace Technologies Inc. ("OurSpace," "we," "us," or "our") maintains this Policy to help protect Hosts, Renters, neighbouring property, the public, and the Platform.

By using the Platform, you agree not to list, offer, request, arrange, permit, place, park, store, transfer, or facilitate any item prohibited by this Policy. This Policy applies whether the item belongs to you, is temporarily in your possession, or is held on behalf of another person or entity.

This Policy forms part of and is incorporated into the OurSpace App Terms & Conditions ("Terms"), Host Agreement, Renter Agreement, applicable Booking details, and other incorporated policies. The Renter Agreement, Host Agreement, Prohibited Items Policy, and Refund & Cancellation Policy are available at https://ourspacetech.com/user-agreements/.

Capitalized terms not defined in this Policy have the meanings given in the Terms. Nothing in this Policy permits an item or activity prohibited by law, a Host's lawful listing restrictions, the Booking details, an insurance requirement, a property rule, or another applicable OurSpace policy.

  1. General Rule

Users must not use the Platform in connection with any item that is:

  • illegal to possess, store, transport, sell, distribute, produce, import, export, or use;

  • stolen, counterfeit, fraudulent, or obtained unlawfully;

  • explosive, flammable, corrosive, toxic, infectious, radioactive, unstable, or otherwise dangerous or hazardous;

  • perishable or likely to spoil, rot, leak, create odours, attract pests, or cause contamination;

  • regulated in a manner that makes ordinary peer-to-peer storage or parking inappropriate;

  • prohibited by this Policy, the listing, or the Booking details; or

  • reasonably likely to create an unreasonable risk to people, animals, property, the environment, or the Platform.

An item may be prohibited by OurSpace even if a user may lawfully possess it. OurSpace's restrictions are Platform safety and risk-management rules and do not represent a determination that every listed item is illegal in all circumstances.

The examples below are illustrative and not exhaustive. A substance, component, device, container, or material that is substantially similar to a listed item or creates a comparable risk may also be prohibited.

  1. Illegal, Stolen, Counterfeit, or Unlawfully Obtained Items

Users must not store or facilitate storage of:

  • stolen or unlawfully obtained property;

  • counterfeit goods or fraudulent documents;

  • contraband;

  • property used or intended for fraud, trafficking, unlawful production, or other criminal activity;

  • unlawfully possessed controlled substances; or

  • any other item whose possession, storage, transport, sale, distribution, production, import, export, or use violates applicable law.

  1. Explosives, Fireworks, Ammunition, and Propellants

Users must not store or facilitate storage of:

  • explosives or blasting materials;

  • fireworks or pyrotechnics;

  • detonators, blasting caps, fuses, or similar initiation devices;

  • rocket motors;

  • black powder, gunpowder, smokeless powder, or other propellants;

  • ammunition of any type or quantity;

  • explosive precursors, components, or materials intended to create an explosive or pyrotechnic device; or

  • any container, equipment, or material presenting a comparable explosion risk.

  1. Firearms, Weapons, and Related Components

Users must not store or facilitate storage of:

  • firearms of any kind, including non-restricted, restricted, and prohibited firearms;

  • prohibited or restricted weapons;

  • firearm frames, receivers, barrels, slides, bolts, firing mechanisms, or other key firing components;

  • magazines, cartridges, ammunition, or regulated firearm accessories;

  • crossbows intended or configured for use as weapons;

  • knives, devices, or other weapons prohibited by law; or

  • imitation, replica, deactivated, or modified weapons where their storage could reasonably create a safety, security, or legal risk.

These items are prohibited by OurSpace even where a person may otherwise lawfully possess or store them.

  1. Dangerous Goods and Hazardous Materials

Users must not store or facilitate storage of dangerous goods, hazardous materials, hazardous waste, or other substances that are explosive, gaseous, flammable, combustible, oxidizing, reactive, toxic, infectious, radioactive, corrosive, environmentally hazardous, or otherwise unsafe for the booked Space.

Prohibited items include, without limitation:

  • gasoline, diesel, kerosene, or other fuel in portable containers;

  • propane tanks, butane cylinders, acetylene cylinders, and other compressed-gas cylinders;

  • solvents, paint thinner, industrial chemicals, or large or unsafe quantities of paint or varnish;

  • pool chemicals, pesticides, fertilizers with hazardous properties, oxidizers, or organic peroxides;

  • strong acids, caustics, toxic cleaning concentrates, or corrosive substances;

  • unstable, recalled, swollen, leaking, damaged, modified, or improperly stored lithium batteries;

  • hazardous, industrial, chemical, or contaminated waste;

  • materials requiring dangerous-goods markings, specialized packaging, documentation, handling, or emergency-response procedures; and

  • any substance in a damaged, leaking, unlabelled, incompatible, or unsafe container.

Ordinary household products in small quantities are not automatically permitted. They remain prohibited where their amount, condition, packaging, combination, storage requirements, or the characteristics of the Space create an unreasonable risk.

  1. Cannabis, Illicit Drugs, and Production or Trafficking Materials

Users must not store or facilitate storage of:

  • cannabis, cannabis plants, cannabis products, cannabis extracts, or bulk cannabis;

  • commercial, resale, distribution, or unlicensed cannabis inventory;

  • illicit drugs or unlawfully possessed controlled substances;

  • substances intended for unlawful trafficking, production, or distribution;

  • equipment, materials, or supplies intended for illicit drug or cannabis production, processing, trafficking, sale, or distribution; or

  • any other unlawful drug-related inventory or material.

OurSpace prohibits cannabis and cannabis-related commercial inventory as a Platform rule even though limited possession of cannabis may be lawful in Canada in some circumstances.

  1. Prescription Drugs, Controlled Medications, and Regulated Medical Substances

Users must not store or facilitate storage of:

  • prescription drugs intended for resale, transfer, or unauthorized distribution;

  • controlled medications;

  • temperature-sensitive or environmentally sensitive drugs;

  • clinical, pharmacy, veterinary, or commercial drug stock;

  • regulated medical substances requiring secure chain of custody; or

  • medication or medical inventory requiring licensed, monitored, refrigerated, sterile, or otherwise controlled storage.

  1. Infectious, Biohazardous, Radioactive, or Medical Materials

Users must not store or facilitate storage of:

  • infectious substances or biohazardous materials;

  • human remains, human tissue, organs, bodily fluids, or biological specimens requiring controlled conditions;

  • sharps, needles, clinical waste, biomedical waste, or contaminated materials;

  • radioactive materials, nuclear substances, or contaminated radioactive equipment;

  • radiation devices; or

  • laboratory, medical, dental, veterinary, or research materials presenting biological, chemical, radiological, contamination, or chain-of-custody risks.

  1. Perishable, Rotting, Leaking, or Pest-Attracting Items

Users must not store or facilitate storage of:

  • perishable food;

  • raw meat, seafood, or animal products;

  • refrigerated or frozen food;

  • food likely to spoil or requiring temperature control;

  • garbage, compost, organic waste, or food waste;

  • items that are wet, infested, contaminated, actively moulding, or likely to develop mould; or

  • any item likely to rot, ferment, leak, create persistent odours, or attract insects, rodents, wildlife, or other pests.

Shelf-stable food is not automatically permitted. It must be lawful, securely sealed, appropriately packaged, accepted by the Host, suitable for the Space, and unlikely to create odour, contamination, infestation, or other risk.

  1. Living Things and Biological Matter

Users must not use a Space to store, house, conceal, or leave:

  • any person;

  • animals, pets, livestock, insects, or other living creatures;

  • plants requiring watering, temperature control, lighting, ventilation, monitoring, or other active care; or

  • biological specimens or living cultures requiring controlled conditions.

A Space must not be used for sleeping, residing, sheltering, boarding, cultivation, habitation, or any other form of occupancy.

  1. Cash, Identity Documents, Securities, and High-Value or Irreplaceable Items

Users must not store or facilitate storage of:

  • cash or currency;

  • coins held primarily for investment or unusually high-value resale;

  • securities, negotiable instruments, bearer instruments, or similar financial documents;

  • passports, government identity documents, or irreplaceable legal records;

  • jewellery, watches, precious metals, gemstones, or collectibles of unusually high value; or

  • fine art, antiques, rare items, or other property requiring specialized secure, insured, or vault storage.

This section is a Platform risk-management rule. Users remain responsible for assessing the suitability of a Space and maintaining appropriate insurance for all permitted Stored Items.

  1. Items Requiring Specialized, Licensed, or Controlled Storage

Users must not store or facilitate storage of any item that reasonably requires:

  • temperature- or humidity-controlled storage not expressly provided by the listing;

  • secure vault or high-security storage;

  • licensed commercial, pharmaceutical, laboratory, industrial, bonded, or regulated storage;

  • controlled hazardous-material handling;

  • quarantine, sanitation, sterile, contamination-control, or chain-of-custody procedures;

  • continuous monitoring, active maintenance, or specialized fire suppression; or

  • permits, licences, approvals, documentation, staff, equipment, or operating conditions not provided for the Booking.

  1. Vehicles, Recreational Vehicles, and Parking Spaces

A vehicle, trailer, recreational vehicle, motorcycle, boat, or other unit may be parked only where expressly permitted by the listing and Booking details and only if it complies with applicable law, property rules, and Host restrictions.

An otherwise permitted vehicle or unit is not prohibited solely because it contains ordinary fuel, batteries, lubricants, coolant, or other operating materials safely contained in manufacturer-installed systems and in normal operating condition. However, users must not park or store:

  • a vehicle or unit that is leaking fuel, oil, coolant, battery fluid, sewage, chemicals, or another hazardous substance;

  • a vehicle or unit presenting a material fire, electrical, contamination, structural, environmental, or security risk;

  • loose fuel containers, detached propane cylinders, damaged batteries, or other prohibited materials inside or beside the vehicle or unit;

  • a vehicle or unit containing undisclosed or prohibited cargo; or

  • a vehicle or unit used for habitation, unlawful activity, hazardous-material storage, or another use not permitted by the Booking.

OurSpace or the Host may require information reasonably necessary to confirm that a vehicle or unit is suitable for the Space.

  1. Items Creating an Unreasonable Risk

Users must not store or facilitate storage of any item that, in OurSpace's reasonable judgment, could:

  • endanger a person, animal, property, or the environment;

  • violate law, regulation, a court order, a property rule, or an insurance requirement;

  • damage, overload, contaminate, obstruct, or materially alter the Space or neighbouring property;

  • create a fire, explosion, electrical, water, structural, odour, infestation, sanitation, security, or environmental risk;

  • interfere with emergency access or safe use of the property;

  • require handling, monitoring, expertise, equipment, or safeguards not available at the Space; or

  • expose OurSpace, a Host, a Renter, a neighbour, or another person to unreasonable legal, financial, safety, or reputational risk.

OurSpace may determine that an item is prohibited based on its type, amount, condition, packaging, location, combination with other items, intended use, regulatory status, or the characteristics of the Space.

  1. Renter Responsibilities

Renters are responsible for ensuring that every Stored Item is lawful, safe, properly packaged, accurately disclosed where required, suitable for the Space, and permitted by this Policy, the listing, the Booking details, and applicable law.

A Renter must:

  • own the Stored Items or have full legal authority to possess and store them;

  • review this Policy before drop-off;

  • comply with all quantity, packaging, access, vehicle, and item restrictions in the listing and Booking details;

  • promptly answer reasonable safety or compliance questions from OurSpace;

  • not place any prohibited item in a Space, even with a Host's consent; and

  • promptly and safely remove an item that OurSpace or the Host reasonably identifies as prohibited, subject to lawful safety instructions.

Renters must not attempt to avoid this Policy by:

  • mislabelling an item or container;

  • concealing or misrepresenting the nature, condition, quantity, ownership, or intended use of an item;

  • splitting prohibited contents across containers, Bookings, accounts, or Spaces;

  • moving a Platform-originated transaction off the Platform; or

  • failing to disclose an unusual or material risk when disclosure is reasonably required.

  1. Host Responsibilities

Hosts must not knowingly accept, authorize, encourage, or permit prohibited items. A Host's consent does not override this Policy or applicable law.

A Host must:

  • maintain any lawful item restrictions disclosed in the listing;

  • promptly report suspected prohibited or dangerous items to OurSpace;

  • avoid opening, searching, handling, moving, using, seizing, destroying, or disposing of Stored Items except with the Renter's consent or where reasonably necessary for immediate safety, emergency response, legal compliance, or another lawful process; and

  • follow reasonable safety instructions from emergency services, public authorities, or OurSpace.

This Policy does not give a Host a general right to inspect a Renter's closed containers or take unlawful self-help action against Stored Items.

  1. Reporting and Immediate Safety

Users should promptly report suspected prohibited items through the Platform, Help Centre, Resolution Centre, or the contact information below.

If an item presents an immediate threat to life, health, property, or the environment, users should move to safety and contact 911 or the appropriate emergency authority before contacting OurSpace. Users should not touch, open, move, transport, neutralize, or dispose of a suspected explosive, leaking chemical, biohazard, weapon, or other dangerous item unless directed by qualified authorities.

A report should include only information and evidence that can be obtained safely and lawfully. Users must not create additional danger to photograph, inspect, or document a suspected item.

  1. OurSpace Review and Enforcement

If OurSpace reasonably suspects, receives a report of, or becomes aware of a potentially prohibited item, OurSpace may, subject to applicable law:

  • request information, documentation, photographs, or clarification;

  • review relevant listings, Bookings, messages, photographs, verification records, support records, and payment records in accordance with the Privacy Policy;

  • require that an item not be delivered or that it be lawfully and safely removed;

  • pause, restrict, cancel, or terminate a Booking;

  • remove or restrict a listing;

  • restrict, suspend, or terminate an account or Platform feature;

  • place a reasonable payment, payout, refund, or account hold while the matter is reviewed;

  • preserve relevant records;

  • contact emergency services, police, regulators, property owners, insurers, or other appropriate authorities;

  • cooperate with lawful requests, court orders, warrants, investigations, or reporting obligations; and

  • take other reasonable action to protect people, property, the environment, users, or the Platform.

OurSpace may take immediate action without advance notice where reasonably necessary for safety, emergency response, fraud prevention, legal compliance, evidence preservation, or prevention of further harm.

Cancellation, refund, payout, fee, damage, cleanup, removal, and account consequences are governed by the Terms, Refund & Cancellation Policy, applicable role agreement, Booking details, and law. Storing a prohibited item may result in loss of refund eligibility and responsibility for reasonable documented loss, damage, cleanup, transport, professional response, remediation, fines, or other costs to the extent permitted by law.

OurSpace does not take physical possession or custody of Stored Items and does not guarantee that it will identify every prohibited item. A Platform review is not a substitute for emergency services, law enforcement, regulatory authorities, insurers, or legal advice.

  1. Changes to This Policy

OurSpace may update this Policy in accordance with the Terms and applicable law.

For a material change, OurSpace will provide at least 14 days' advance notice before the change takes effect by email to the address associated with the user's account and by posting the updated Policy on the Platform.

Where a change materially affects an existing Booking, OurSpace will apply the version that lawfully governs that Booking and provide any additional notice or consent opportunity required by law.
